Announcement on perpetual suspension of litigation

With reference to the legal action taken by MOL on July 17th 2008 against OMV, due to false allegations and defamation, being accused of indiscretion with regards to the Statement of Objections sent by the European Commission as part of its competition investigation, The parties have settled this litigation by way of perpetual suspension of the proceedings „ewiges Ruhen”, after the following statement has been issued:

The defendant (OMV) clarifies the meaning of the statement of its spokesperson Thomas Huemer as follows:

“The statement in no case implied the suspicion that the plaintiff (MOL) had infringed the existing duty to observe secrecy in the merger control procedure before the European Commission. If the statement or the press coverage based on the statement from July 11th 2008 has been misunderstood, the defendant regrets that.”
